How Quickly Things Change
A federal district court in Illinois recently ruled that the former owner of a heating system that contained asbestos couldn’t be held liable under federal hazardous waste laws for abandoning the old system after the property was sold.
Now the court has reversed itself, finding that it erred in dismissing claims under Superfund and the Resource Conservation and Recovery Act (RCRA) against the ex-owner of the heating system. The court said it had read the complaint as alleging that asbestos materials were built into the system itself.
