Dueling legislative proposals in the 108th Congress concerning an employee’s right to decide on union representation are heading to the forefront in the 109th Congress. The Secret Ballot Protection Act (H.R. 4343, S. 2637) would essentially outlaw the card-check approach and require unions to accept NLRB elections. (Currently, H.R. 4343 has 56 cosponsors; S. 2637 has 0 cosponsors).
