TRSA’s latest webinar, “Drug Testing in an Era of Marijuana and Opioids,” sponsored by JENSEN, features Jennifer Sandberg, a partner at the Fisher Phillips Law Firm, Atlanta. Sandberg focused on many issues related to drug testing, mainly on the tricky nature of testing in the age of medical marijuana, legalized recreational marijuana use and opioids.

Sandberg stressed that a drug policy is an important tool for all businesses to have in place, but implementing it in a fair, accurate and legal way can sometimes be difficult. Potential concerns include ensuring compliance with the Americans with Disabilities Act (ADA), the Family and Medical Leave Act (FMLA). Sandberg also discussed why going with a “zero-tolerance policy” may be more difficult than it sounds.

  • Knowing current state/federal laws

  • Focusing on prevention, rather than punishment
  • Identifying priorities
