NLRB Releases Notice to Establish New Joint-Employer Standard

The National Labor Relations Board (NLRB) recently released its long-anticipated notice of proposed rulemaking (NPRM) to establish a new “joint-employer” legal standard under the National Labor Relations Act (NLRA).

If implemented, the proposed rule would:

  • Make the collective bargaining process infinitely more complex
  • Minimize franchisees’ control over their own businesses
  • Allow the courts and the NLRB to determine joint employment subjectively

TRSA is working with a group of other industry stakeholders, including the American Hotel & Lodging Association, the International Franchise Association, the National Restaurant Association, the National Retail Federation and other members of the Coalition to Save Local Businesses to engage congressional allies and push back on this harmful proposed regulation. Formal comments to the NPRM are due to the NLRB before Nov. 7.
